DUFUNDED — RISK DISCLOSURE & NO FINANCIAL SERVICES NOTICE

1. EVALUATION, SOFTWARE AND SIMULATED TRADING

DuFunded provides access to software, evaluation Challenges, dashboards, analytics, data-processing tools, educational materials and simulated trading environments. The Services are designed for software use, skill development, performance assessment, education and data analysis.

All trading activity within Challenge Accounts, Funded Accounts and Instant Funding Accounts is simulated. DuFunded does not route your orders to a live exchange, broker, liquidity provider or other live market venue on your behalf.

Your trading activity is used to evaluate your performance against the applicable program rules. The trading environment is not a live brokerage account and does not give you ownership of real market positions or financial instruments.

2. NO REAL TRADING OR CLIENT FUNDS

DuFunded does not provide brokerage, investment management, portfolio management, custody or other services involving client trading capital.

DuFunded does not accept, hold, safeguard, pool, invest or manage client funds for the purpose of live trading.

Participants do not use DuFunded to place live market orders and do not trade real financial assets through the DuFunded trading environment.

The Challenge fee is a fixed service fee for access to the applicable evaluation program, software and related digital services. It is not a deposit, investment, trading balance, margin, collateral or client money.

3. VIRTUAL BALANCES AND ACCOUNT SIZES

All account balances, account sizes, profits, losses, targets, drawdowns, risk metrics and other trading figures displayed within Challenge or Funded-stage environments are virtual or notional.

These figures are used for simulation, evaluation, rule calculations, performance tracking and determining eligibility for applicable Performance Rewards.

Virtual balances do not represent money held for you, money deposited by you, or trading capital owned by you.

Virtual balances cannot be withdrawn, transferred, pledged, used as collateral or converted into real trading capital.

4. PERFORMANCE REWARDS / PAYOUTS

DuFunded may provide Performance Rewards based on the applicable program rules and a participant’s simulated performance.

For purposes of the Services, terms such as “Payout”, “Profit Split” or “Funded Account” describe mechanisms used to calculate and provide a contractual Performance Reward based on the applicable program conditions.

A Performance Reward is not a withdrawal of client funds, repayment of a deposit, investment return, dividend, interest payment or distribution of profits generated by a participant’s live trading activity.

Any payment described as a Payout is a contractual Performance Reward provided by DuFunded under the applicable program terms. It does not represent profits generated from live market execution on behalf of the participant.

Eligibility for a Performance Reward may be subject to applicable trading rules, payout conditions, identity verification, compliance checks, fraud prevention procedures and platform-integrity reviews.

Performance Rewards are not guaranteed and are payable only where the participant remains eligible under the applicable program terms. DuFunded may place a Performance Reward on hold, suspend processing, or decline a payout where DuFunded reasonably determines that the participant may have violated the applicable program rules, trading restrictions, account-integrity requirements or other applicable terms.

Where a review identifies a material or confirmed violation, DuFunded may cancel or permanently withhold the affected Performance Reward and may take other measures permitted under the applicable program terms, including restricting or terminating the relevant account.

A payout request or previously displayed profit figure does not create an unconditional right to payment. DuFunded may conduct additional compliance, fraud, trading-activity or account-integrity reviews before approving a Performance Reward.

5. SIMULATED PERFORMANCE LIMITATIONS

Simulated and hypothetical trading results have inherent limitations. Unlike trading through a live market account, simulated trading does not represent actual market execution.

Because simulated trades are not executed in live markets, results may not reflect the effects of live liquidity, order-book depth, slippage, commissions, spreads, market gaps, rejected orders, execution delays, partial fills, liquidity conditions or other factors present in live trading.

Simulated trading may also produce results that differ materially from results that could be achieved in a live trading environment.

No representation is made that any participant, strategy, Challenge Account, Funded Account or Instant Funding Account will achieve any particular level of profit, performance, pass rate or Performance Reward.

Past performance, simulated results, Challenge results, testimonials, leaderboard results and payout examples are not guarantees of future results.

6. NO INVESTMENT OR FINANCIAL ADVICE

Nothing in the Services constitutes investment, financial, legal, tax or accounting advice, or a personal recommendation.

DuFunded does not recommend that you buy, sell, hold or trade any financial instrument, security, derivative, commodity, foreign-exchange instrument, crypto-asset or other asset.

Any educational material, market-related information or trading-related content provided by DuFunded is for general informational or educational purposes only and should not be relied upon as the sole basis for any financial decision.

You should obtain advice from an appropriately qualified professional before engaging in live trading or investing outside DuFunded.

7. EXTERNAL TRADING RISK

Trading or investing in financial markets outside DuFunded can involve substantial risk, including the possible loss of all capital used for trading or investing.

The simulated environment provided by DuFunded may be used to assess trading skills, discipline and risk management, but passing a Challenge or achieving simulated profits does not establish or guarantee success in live financial markets.

8. TECHNOLOGY, PLATFORM AND DATA RISK

The Services may depend on third-party trading technology, software, market-data feeds, servers, internet connections, devices, wallets, payment tools and other technical systems.

Technical failures, outages, delays, data errors, price discrepancies, disconnections, software changes, access issues and other interruptions may occur.

DuFunded cannot guarantee continuous availability, uninterrupted access or error-free operation of the Services.

Participants are responsible for maintaining an appropriate device, internet connection and account-security practices when accessing the Services.

9. PROGRAM RULES AND ACCOUNT INTEGRITY

All participants must comply with the applicable DuFunded program rules and trading restrictions.

DuFunded may monitor simulated trading activity, account activity, technical information and other relevant data to verify compliance, prevent fraud and abuse, protect platform integrity and identify prohibited or artificially coordinated activity.

This may include reviewing trading patterns, risk exposure, account relationships and other relevant information where necessary to enforce the applicable rules.

Violations of the program rules may result in account restrictions, termination of an account, cancellation of evaluation results or ineligibility for applicable Performance Rewards, in accordance with the applicable program terms.

10. ACKNOWLEDGEMENT

By purchasing a Challenge or using the Services, you acknowledge and agree that:

• the Services use simulated trading environments and technology-based evaluation;
• trading activity within DuFunded is not live market trading;
• account balances and trading results displayed within the Services are virtual or notional;
• the Challenge fee is a service fee and not a deposit or investment;
• DuFunded does not hold client trading funds for use in live trading;
• “Funded Account”, “Payout” and “Profit Split” are terms describing the structure of the applicable simulated program and contractual Performance Rewards;
• any Performance Reward is subject to the applicable program rules, conditions and compliance review;
• DuFunded may place a payout on hold, decline or withhold a Performance Reward when a violation or other eligibility issue is reasonably identified under the applicable terms; and
• no trading outcome, profit or Performance Reward is guaranteed.
